Terms & Conditions

1. General

• By registering and making payment, you confirm that you have read and agreed to these Terms & Conditions.
• All prices are stated in Malaysian Ringgit (MYR) unless otherwise stated.

2. Transportation

• The Organizer is not responsible for accidents, injuries, delays, or losses involving transportation during the trip.
• If you miss any scheduled transport due to your own reasons, you are responsible for arranging and paying for your own alternative transport.
• Transportation schedules cannot be changed to suit individual requests.
• Please arrive on time. Drivers will wait up to 30 minutes after the scheduled pickup time. Late arrivals may be treated as a no-show without refund.
• The Organizer is not responsible for flight delays, cancellations, or missed connections. Please arrange your flights accordingly.
• Transportation services are only valid for the dates stated in your confirmed itinerary.

3. Trip Changes & Participant Responsibilities

• If the trip is cancelled due to government restrictions, pandemics, natural disasters, or other force majeure events, payments are generally non-refundable, except for refunds successfully received from third-party providers.
• If hiking is stopped due to weather or safety instructions from local authorities, no refund will be given for unused services.
• The Organizer may change the itinerary if required for safety or operational reasons.
• If you decide to stop the hike for personal reasons, no refund will be provided, and any additional costs are your responsibility.
• Participants must keep up with the group’s schedule. Any extra costs caused by delays will be charged to the participant responsible.
• You are responsible for bringing suitable trekking equipment. The Organizer may refuse participation if your equipment is considered unsafe.
• Accommodation and room arrangements are assigned by the Organizer and cannot be changed upon request.
• If you hire your own porter or guide, you are responsible for your belongings during that period.

4. Registration & Payment

• Your booking is confirmed only after payment is received and acknowledged by the Organizer.
• A deposit is required to reserve your place.
• Before the trip is officially confirmed, you may cancel and receive a full refund of your deposit.
• Once the trip is announced as a Guaranteed Departure, the deposit becomes non-refundable.
• Full payment is due 60 days before departure.
• If you register within 60 days of departure, full payment is required immediately.
• Failure to pay on time may result in automatic cancellation without refund.
• Participants are responsible for providing accurate personal information.
• Any bank charges, currency conversion fees, or international transfer fees are the participant’s responsibility.

5. Insurance & Liability

• Comprehensive travel insurance is mandatory and should cover:
  • Medical expenses
  • Emergency evacuation
  • Personal accidents
  • Trip cancellation or interruption
  • Loss of personal belongings
• Adventure travel involves risks. By joining the tour, you accept these risks and participate voluntarily.
• The Organizer is not responsible for injuries, illnesses, medical expenses, rescue costs, or lost personal belongings, except where required by law due to proven gross negligence.

6. Cancellation & Refund Policy

Before the trip is confirmed

• Full refund or full credit note.

After the trip is confirmed

• More than 60 days before departure:
  • Deposit is non-refundable.
• 31–60 days:
  • 30% refund of the package price.
• 15–30 days:
  • 20% refund.
• 8–14 days:
  • 10% refund.
• 0–7 days:
  • No refund.

Refunds may exclude non-refundable third-party costs such as permits, visas, flights, processing fees, or payment gateway charges.

7. Change of Tour Date

• Date changes are only allowed for the same tour within 12 months, subject to availability.
• Requests made:
  • More than 60 days before departure: No change fee (price differences may apply).
  • 31–60 days before departure: 10% change fee plus any price difference.
  • Within 30 days before departure: No date changes allowed.
• Early bird or promotional prices may not transfer to the new departure date.

8. Organizer’s Rights The Organizer may:

• Change the itinerary for safety or operational reasons.
• Cancel or postpone the trip due to insufficient participants, force majeure, or safety concerns.
• Replace hotels or services with similar alternatives.
• Remove participants whose behavior is unsafe, disruptive, or unlawful without refund.
• Issue safety instructions that all participants must follow.

9. Environmental & Cultural Responsibility

Participants must:

• Respect nature and local communities.
• Not litter or damage the environment.
• Use designated toilet facilities where provided.
• Behave respectfully towards local people, guides, and fellow traveler.

Participants are responsible for any fines or legal consequences resulting from their own actions.

10. Photos & Media

• The Organizer may take photos and videos during the trip for marketing and promotional purposes.
• If you do not wish to appear in promotional material, please notify the Organizer in writing before the tour begins.
• While reasonable efforts will be made, complete exclusion from group photos cannot be guaranteed.
• All media created by the Organizer remains its intellectual property.

11. General

• The Organizer is not responsible for activities or services outside the purchased tour package.
• These Terms & Conditions may be updated when necessary. Changes will generally apply to future bookings unless required by law or unavoidable operational circumstances.
• These Terms & Conditions are governed by the laws of Malaysia, and any disputes will be handled by the Malaysian courts.
